Welcome to Wellyum ("the App", "we", "us", or "our"), operated by Raidea LLC. By downloading, accessing, or using Wellyum, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using our services.

1. Age Requirement and Acceptance of Terms

AGE REQUIREMENT: You must be at least 13 years of age to use Wellyum. By using this App, you represent and warrant that you are at least 13 years old. If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By accessing or using Wellyum, you confirm that you:

Are at least 13 years of age - Users under 13 are strictly prohibited from using this App
If between 13-17 years of age, have obtained parental or guardian consent to use this App and your parent/guardian has agreed to these Terms
Have the legal capacity to enter into a binding agreement (or have a parent/guardian who can do so on your behalf)
Accept and agree to be bound by these Terms and our Privacy Policy
Will use the App in compliance with all applicable laws and regulations
Understand that you use this App entirely at your own risk

If you do not meet these requirements or do not agree to these Terms, you must immediately stop using Wellyum and delete the App.

2. Description of Service

Wellyum is a recipe modification application that uses artificial intelligence to suggest lower-calorie ingredient alternatives. Our services include:

Importing recipes from URLs, photos, or manual text entry
AI-powered ingredient swap suggestions to reduce calorie content
Recipe storage and organization
Estimated calorie reduction calculations

Wellyum is provided for informational and entertainment purposes only. It is not a medical device, nutritional counseling service, or dietary planning tool.

2.1 Third-Party Services

The App integrates with third-party services to provide and improve our offerings. These include:

Meta (Facebook) SDK: Used for analytics and advertising measurement, including tracking app installs and in-app events for ad campaign attribution. Meta's use of this data is subject to Meta's Terms of Service and Meta's Privacy Policy.
AI Processing: Recipe analysis and modification powered by Anthropic (Claude) AI services.
Firebase/Google Cloud: Authentication, data storage, and cloud infrastructure.

By using Wellyum, you acknowledge and consent to the data practices of these third-party services as described in our Privacy Policy.

THE APP PROVIDES AI-GENERATED SUGGESTIONS THAT MAY BE INACCURATE, INCOMPLETE, OR INAPPROPRIATE FOR YOUR INDIVIDUAL CIRCUMSTANCES. Wellyum does not provide:

3.2 AI-Generated Content Warning

AI WARNING: All recipe modifications, ingredient suggestions, and nutritional estimates are generated by artificial intelligence. AI-generated content may contain errors, inaccuracies, nonsensical suggestions, or potentially dangerous recommendations. You must independently verify all information before use.

AI-generated content in Wellyum:

May contain factual errors or inaccuracies
Is NOT reviewed or verified by humans before being displayed
May produce unexpected, illogical, or inappropriate results
May suggest ingredient combinations that are unsafe, unpalatable, or unsuitable
May not account for cultural, religious, ethical, or personal dietary requirements
May misidentify or incorrectly categorize ingredients
Should ALWAYS be reviewed and verified by the user before any use

3.3 Allergy and Dietary Restrictions Disclaimer

ALLERGY WARNING - LIFE-THREATENING RISK: Wellyum does NOT guarantee allergen-free recipes. Our AI may suggest ingredients that contain allergens. Failure to independently verify ingredients could result in severe allergic reactions, anaphylaxis, or death. Users with food allergies use this App entirely at their own risk.

Allergens that may be present in suggested ingredients include but are not limited to:

Do NOT rely on Wellyum's nutritional estimates for medical conditions such as diabetes, kidney disease, heart disease, eating disorders, or any condition requiring precise dietary management.

3.5 Food Safety and Cooking Disclaimer

COOKING SAFETY WARNING: Wellyum does NOT provide food safety guidance. Improper food handling, storage, or cooking can cause serious illness or death. You assume all risk associated with preparing and consuming food.

Wellyum is NOT responsible for and does NOT provide guidance on:

Proper food handling, storage, or sanitation
Safe cooking temperatures for meats, poultry, seafood, or other foods
Prevention of foodborne illness (salmonella, E. coli, listeria, etc.)
Cross-contamination prevention
Food expiration, freshness, or spoilage

4. Complete Assumption of Risk

ASSUMPTION OF RISK: BY USING WELLYUM, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOU USE THE APP AND ALL RECIPES, SUGGESTIONS, AND INFORMATION PROVIDED ENTIRELY AT YOUR OWN RISK. YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH SUCH USE, INCLUDING BUT NOT LIMITED TO THE RISK OF ILLNESS, INJURY, OR DEATH.

You understand and agree that:

Cooking and food preparation involve inherent risks including burns, cuts, fires, and foodborne illness
AI-generated suggestions may be incorrect, unsafe, or unsuitable
You are solely responsible for verifying all information before use
You are solely responsible for all outcomes related to your use of recipes or suggestions from the App
Wellyum and Raidea LLC have no control over how you prepare, cook, or consume food

5. User Responsibilities

By using Wellyum, you agree to:

Use the App entirely at your own risk
Independently verify ALL recipe information, ingredients, and nutritional data before use
NOT rely solely on AI suggestions for health, dietary, or cooking decisions
Check all ingredients for allergens and substances that may be harmful to you or others
Follow proper food safety practices at all times
Inform all persons consuming food prepared using the App of all ingredients used
Take full responsibility for any adverse reactions, illness, injury, or other consequences
Consult with qualified professionals before making dietary changes
NOT use the App for commercial food service without independent professional verification
Report any errors, concerns, or issues to us promptly
Supervise any minors using the App or consuming food prepared using App suggestions

6. Limitation of Liability

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WELLYUM, RAIDEA LLC, AND THEIR OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING FROM YOUR USE OF THE APP.

We shall NOT be liable for any:

Allergic reactions, food sensitivities, or adverse reactions of any kind
Foodborne illness, food poisoning, or any illness related to food consumption
Personal injury, including but not limited to burns, cuts, or other cooking injuries
Death or serious injury
Property damage, including fire damage or kitchen damage
Inaccuracies in nutritional information, calorie counts, or ingredient data
Errors, omissions, or inaccuracies in AI-generated content
Recipes that do not meet your expectations or dietary needs
Indirect, incidental, special, consequential, or punitive damages
Loss of data, profits, revenue, or business opportunities
Emotional distress or mental anguish
Any other damages of any kind

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

7. Indemnification

You agree to indemnify, defend, and hold harmless Wellyum, Raidea LLC, and their owners, officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising from or related to:

Your use of the App or any recipes, suggestions, or information obtained from it
Food you prepare, serve, or consume using information from the App
Any allergic reaction, illness, injury, or death related to your use of the App
Your violation of these Terms
Your violation of any third-party rights
Any claim by a third party related to food you prepared using the App
Your negligence or willful misconduct

8. Disclaimer of Warranties

WELLYUM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT
WARRANTIES THAT RECIPES WILL BE SAFE, EDIBLE, OR ACHIEVE ANY DESIRED OUTCOME
WARRANTIES THAT NUTRITIONAL INFORMATION IS ACCURATE
WARRANTIES THAT INGREDIENT SUBSTITUTIONS WILL BE SAFE OR APPROPRIATE

9. Subscription and Payments

9.1 Free Features

Certain features may be available without a subscription. These features are subject to change at any time.

9.2 Subscription Terms

Subscriptions are billed on a recurring basis as specified at the time of purchase
Payments are processed through Apple App Store
You may cancel your subscription at any time through your device's subscription settings
Cancellation takes effect at the end of the current billing period
No refunds are provided for partial subscription periods
We reserve the right to change subscription pricing with reasonable notice

9.3 Usage Limits

Subscribed users receive a monthly allotment of recipe conversions. Unused conversions do not roll over. We reserve the right to modify usage limits with notice.

10. Intellectual Property

10.1 Our Content

All content, features, and functionality of Wellyum (including design, text, graphics, logos, and software) are owned by Raidea LLC and protected by intellectual property laws.

10.2 User Content

You retain ownership of recipes you create or import. By using Wellyum, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display your content for the purpose of providing our services.

10.3 Third-Party Recipes

When importing recipes from external sources, you are responsible for ensuring you have the right to use and modify that content.

11. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including if you:

Violate these Terms of Service
Engage in fraudulent, illegal, or harmful activity
Abuse the service or attempt to circumvent usage limits
Harass other users or our staff

12. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using Wellyum, you consent to our collection and use of information as described in the Privacy Policy. The App uses third-party analytics and advertising SDKs, including Meta (Facebook) SDK, which may collect device identifiers and app usage data for ad measurement and attribution purposes.

13. Modifications to Terms

We may update these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of Wellyum after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in California for any disputes arising from these Terms or your use of the App.

15. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising from or relating to these Terms or your use of Wellyum shall be resolved through binding individual arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

You agree to waive your right to a jury trial and to participate in a class action lawsuit or class-wide arbitration.

Arbitration shall be conducted in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wellyum regarding your use of the App and supersede all prior agreements and understandings.

ACKNOWLEDGMENT: BY USING WELLYUM, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU FURTHER ACKNOWLEDGE THAT THESE TERMS CONSTITUTE A BINDING LEGAL AGREEMENT BETWEEN YOU AND RAIDEA LLC. IF YOU ARE ACCEPTING THESE TERMS ON BEHALF OF A MINOR BETWEEN 13-17 YEARS OF AGE, YOU REPRESENT THAT YOU ARE THE PARENT OR LEGAL GUARDIAN AND HAVE THE AUTHORITY TO BIND THE MINOR TO THESE TERMS.
